If you create an account on SahmCrypto, you are responsible for maintaining the security of your account credentials. You must provide accurate and complete information during registration. You may not use another person's account without permission. You are solely responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms or remain inactive for more than 12 months. You can delete your account at any time through your account settings. You must notify us immediately at info@sahmtech.co if you become aware of any unauthorized access to or use of your account. We will not be liable for any losses arising from unauthorized use of your credentials.
To the maximum extent permitted by law, SahmCrypto and Sahm Global for Systems & Programming Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use our services. Our total liability for any claims arising from these terms or your use of our services shall not exceed the amount you paid us in the twelve months preceding the claim, or $100 USD, whichever is greater. This limitation applies regardless of the legal theory on which the claim is based. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you to the extent prohibited by applicable local law.
Any dispute arising out of or relating to these Terms of Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in Amman, Jordan, in accordance with the rules of the Jordan Arbitration Association. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction. Each party shall bear its own costs and expenses related to the arbitration, unless the arbitrator determines otherwise. The parties agree to maintain the confidentiality of all arbitration proceedings and any resulting award.
You agree to indemnify, defend, and hold harmless SahmCrypto, Sahm Global for Systems & Programming Technologies LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of our services, your violation of these Terms of Service, or your violation of any rights of a third party. This indemnification obligation shall survive the termination of these terms and your use of our services. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
